Terms of Service

These terms govern your use of the Hilda AI website and service, provided by Dafinitiq. By using the service you agree to them.
1. The service
Hilda AI is an AI receptionist that answers inbound calls and messages on your behalf, and may book appointments, capture lead details, route calls and produce transcripts and summaries, according to the configuration you choose.
2. Your account
You are responsible for the accuracy of the information you configure, for keeping your credentials secure, and for all activity under your account. You must be authorised to act for the business you register.
3. Acceptable use
You must not use the service to:
- Break any law, or infringe anyone's rights.
- Place calls or messages you are not permitted to place, including calls that breach telemarketing, do-not-call or call-recording laws.
- Impersonate another business or person.
- Attempt to reverse engineer, resell or overload the service.
4. Call recording compliance
You are responsible for complying with all recording, monitoring and notification laws that apply to your calls, including obtaining any consent required in your jurisdiction. We provide configurable announcements to assist, but compliance remains your responsibility.
5. Fees and billing
Subscription fees, included usage allowances and overage rates are as set out on our pricing page or in your order form. Fees are billed in advance and are non-refundable except where required by law. We may change pricing on reasonable notice.
6. Cancellation
You may cancel at any time, effective at the end of your current billing period. We may suspend or terminate an account that breaches these terms or that presents a security or legal risk.
7. Service availability and AI limitations
We work to keep the service available and accurate, but it is provided “as is”. AI systems can misunderstand callers, produce incorrect information, or fail to complete a task. You should not rely on the service for emergency, medical, legal or safety-critical communications, and you remain responsible for reviewing outcomes that matter to your business.
8. Your data
You retain ownership of your data. You grant us the licence needed to operate the service for you. Our handling of personal data is described in our Privacy Policy.
9. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental or consequential loss, or for lost profits or revenue. Our total aggregate liability is limited to the fees you paid in the twelve months before the event giving rise to the claim.
10. Governing law
These terms are governed by the laws of the State of Delaware, USA, and the courts of that jurisdiction have exclusive jurisdiction over any dispute.
